Retrospective validation of service by email and procedural compliance by litigants in person: Barton v Wright Hassall LLP

Research output: Contribution to journal › Comment/debate

Abstract

Considers Barton v Wright Hassall LLP (SC) on whether the service by email of a claim form and particulars of claim on a law firm by a litigant in person, which was invalid because the firm had not indicated that it would accept electronic service, should be validated retrospectively on the grounds that a degree of leniency should be afforded to unrepresented claimants and the firm should not be permitted to benefit from "technical games".
